Terms & Conditions
This agreement is between ForwardIt company, and ForwardIt Registered Members (aka Member):
1 - ForwardIt will provide Registered Members with a U.S. street address for his/her use in the U.S.A.
2 - ForwardIt's services consist of receiving the Member's merchandise, sorting it, packing it, transporting it to the Member's country and delivering it to the Member's specified local address during regular business hours.
3 - ForwardIt can store merchandise longer than 30 days, however, there is a storage fee of $3 per package per day starting on the 31st day.
4 - Any charges associated with our services such as taxes, customs duties and service fees presently in effect or established in the future, will be the responsibility of the ForwardIt Member.
5 - If a Member does not pay for services rendered for a period over 30 days, his/her membership may be cancelled by ForwardIt. All items and packages may be returned-to-sender or discarded at the sole discretion of ForwardIt. Member forfeits all claims to items abandoned once his/her Membership is cancelled.
6 - Late Fees. All invoices past due over thirty (30) days will be assessed $10 plus 5% per month late fee. This fee will apply for each month an order is past due.
7 - Shipping charges are based on weight and are rounded up to the nearest pound. Dimensional weight may apply on bulky, lightweight packages. Dimensional weight is used when the result of multiplying the measurement in inches of height times width times length divided by 166 is more than the actual weight in pounds.
8 - ForwardIt will not ship to any embargoed country as established from time to time by the United States government, currently the following countries: Cuba, Iran, Libya, North Korea, Sudan, and Syria.
9 - The ForwardIt Member is responsible for and warrants its compliance with all applicable laws, rules and regulations, including, but not limited to, the export laws and government regulations of any country to, from, through or over which the ForwardIt Member shipment may be carried. The ForwardIt Member agrees to furnish such information and complete and attach such documents as necessary to comply with such laws, rules and regulations, including notifying the United States Principal Party In Interest in every transaction generated by Member of the ultimate destination of any items ordered by Member.
10 - The ForwardIt Member AGREES IT IS NOT A DENIED PERSON AND THAT IT WILL NOT directly or indirectly, participate in any way in any transaction involving any commodity, software or technology (hereinafter collectively referred to as "item") exported or to be exported from the United States that is subject to the Export Administration Regulations (EAR), or in any other activity subject to the EAR, including, but not limited to: A. Applying for, obtaining, or using any license, License Exception, or export control document; B. Carrying on negotiations concerning, or ordering, buying, receiving, using, selling, delivering, storing, disposing of, forwarding, transporting, financing, or otherwise servicing in any way, any transaction involving any item exported or to be exported from the United States that is subject to the EAR, or in any other activity subject to the EAR; or C. Benefiting in any way from any transaction involving any item exported or to be exported from the United States that is subject to the EAR, or in any other activity subject to the EAR. Further, the ForwardIt Member shall not directly or indirectly, do any of the following: A. Export or reexport to or on behalf of any denied person any item subject to the EAR; B. Take any action that facilitates the acquisition or attempted acquisition by a denied person of the ownership, possession, or control of any item subject to the EAR that has been or will be exported from the United States, including financing or other support activities related to a transaction whereby a denied person acquires or attempts to acquire such ownership, possession or control; C. Take any action to acquire from or to facilitate the acquisition or attempted acquisition from the denied person of any item subject to the EAR that has been exported from the United States; D. Obtain from any denied person in the United States any item subject to the EAR with knowledge or reason to know that the item will be, or is intended to be, exported from the United States; or E. Engage in any transaction to service any item subject to the EAR that has been or will be exported from the United States and which is owned, possessed or controlled by a denied person, or service any item, of whatever origin, that is owned, possessed or controlled by a denied person if such service involves the use of any item subject to the EAR that has been or will be exported from the United States. For purposes of this paragraph, servicing means installation, maintenance, repair, modification or testing.
11 - In addition, the ForwardIt Member specifically warrants that it will not tender any shipments to ForwardIt if the ForwardIt Member is listed on the Denied Persons List maintained by the U.S. Department of Commerce. The ForwardIt Member also warrants that it will not attempt to ship to persons or entities listed as Specially Designated Nationals or Blocked Persons by the U.S. Treasury Department. ForwardIt will not carry shipments that violate any U.S. export laws. ForwardIt assumes no liability to the ForwardIt Member or any other person for any loss or expense - including, but not limited to, fines and penalties - if the ForwardIt Member fails to comply with any and all applicable laws and regulations in effect in both the U.S.A. and his/her country. The ForwardIt Member will never use the ForwardIt service to either receive or send illegal materials or controlled substances. The ForwardIt Member will be solely responsible for any penalties or fines resulting from a violation of this condition. The ForwardIt Member represents and warrants that it is not shipping any items which contain or are comprised of hazardous materials, as such term (hazardous materials) is defined by any regulatory agency, including but not limited to any international protocol, World Trade Organization, and any United States' federal, state, or local law.
12 - The ForwardIt Member certifies that all statements and information provided to ForwardIt relating to importation and/or exportation will be true and correct. Furthermore, the ForwardIt Member understands that civil and criminal penalties, including seizures and forfeiture, may be imposed by the governing authorities for making false and fraudulent statements or for the violation of any applicable U.S. law on exportation or export-related customs laws.
13 - Shipments that contain goods or products that are regulated by multiple government agencies within the destination country or within the United States (including but not limited to the Department of Commerce, the Department of State, and comparable agencies in the destination country) may require additional time for clearance. The ForwardIt Member is responsible for making sure goods shipped internationally are acceptable for entry into the destination country. All charges for shipment to and return from countries where entry is not permitted are the Member's responsibility. ForwardIt assumes no responsibility for shipments abandoned in customs, and such shipments may be considered undeliverable.
14 - ForwardIt reserves the right to refuse, hold or return any shipment and may do so at its sole discretion and without liability to ForwardIt. ForwardIt will execute that right when (but not limited to cases in which): (1) the shipment may cause damage or delay to other shipments, property or personnel; (2) the shipment is likely to sustain damage or loss in transit because of improper packaging or otherwise; (3) the shipment contains any prohibited items; (4) the account of the person or entity responsible for payment is not in good credit standing; or (5) when acceptance of the shipment may jeopardize ForwardIt's ability to provide service to other customers. ForwardIt has no liability whatsoever for refusal or rejection of shipments. ForwardIt reserves the right to terminate an ForwardIt Member's access to and use of the ForwardIt systems for any reason, including if ForwardIt in its sole judgment believes that (1) the system is being used for an illegal purpose or a purpose not authorized by ForwardIt, or (2) ForwardIt or a third party's rights are being jeopardized, or (3) ForwardIt or any third party is potentially exposed to liability or damage of any type, or (4) the ForwardIt Member is violating the any applicable agreement between ForwardIt and the ForwardIt Member.
15 - The ForwardIt Member agrees to indemnify, hold harmless and defend ForwardIt, its officers, directors, employees and agents from and against any and all claims, expenses, fines, judgments, damages or awards (including, without limitation, U.S. or foreign export compliance fines or penalties, customs fines or penalties, and reasonable attorney fees) arising out of or related to ForwardIt's preparation, determination or execution of the documents (including international air waybills) or any other document necessary for transportation, including, but not limited to shipment addressing, routing, classification, licensing requirements, and value of goods/documents and value for carriage, except for claims arising solely from the gross negligence or willful misconduct of ForwardIt. The ForwardIt Member further agrees to hold ForwardIt, its officers, directors, employees and agents harmless from and against all claims, damages, liabilities, actions, losses, costs and expenses of any nature whatsoever in any manner arising out of the ForwardIt Member providing to ForwardIt inaccurate or false information or documents. For shipments requiring a U.S. State Department or U.S. Commerce Department export license, the ForwardIt Member agrees that it remains liable for and will hold ForwardIt, its officers, directors, employees, and agents, harmless from and against all claims, damages, liabilities, actions, losses, costs and expenses of any nature whatsoever in any manner arising out of the ForwardIt Member's failure to comply with U.S. law applicable to the exportation of such shipments.
16 - ForwardIt is thereby appointed by the ForwardIt Member as the agent for the ForwardIt Member for the performance of customs clearance, preparation of shipping documents, with full power of attorney to act as such an agent of the ForwardIt Customer to the extent allowed by law. If a Shipper's Export Declaration (S.E.D.) is required, or preparation of a Certificate of Origin for goods manufactured and originating within the United States on behalf of the ForwardIt Member when one is required, ForwardIt will file the required export information on behalf of the ForwardIt Member as its agent pursuant to this section. The ForwardIt Member acknowledges that it has a duty to and is solely liable for maintaining all records as required under the customs or other government agency laws; ForwardIt assumes no responsibility to act as a record-keeper or record-keeping agent for the shipper.
17 - We reserve the right, at our sole discretion, to change, modify, or otherwise alter these terms and condition anytime. Please review the terms and conditions periodically. Your continued use of site following the postings of changes and/or modifications will constitute your acceptance of the terms and conditions.
18 - Illegal activity (as determined by U.S. laws) is not permitted by ForwardIt. Any legal fees incurred by ForwardIt enforcing the laws of the U.S. against a customer or potential customer will be the financial responsibility of the customer.
